Terms of use

Memorabley is provided by Denvo LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States, a Limited Liability Company (LLC) under the law of New Mexico, USA. By creating a page you agree to these terms.

What Memorabley is

Memorabley lets you design personal gift pages and share them by link. You do not need an account for that; only the subscription requires one. We work to keep the service reliable, but cannot promise uninterrupted availability.

The edit link

Every page has a secret edit link. Anyone who knows it can change the page. Keep it safe. If it is lost, we cannot restore it.

Keep it to yourself. Writing along has its own invite link: whoever follows it can add, change and delete blocks, but cannot change the name, design, message or password, publish the page or delete it.

Your content

You are responsible for the content of your page. Only upload material you have the rights to, and only recordings of people who agree. You grant us a non-exclusive, worldwide, royalty-free right to store your content, convert it for display, create previews of it, back it up, deliver it and show it through the link for as long as the page exists. The right ends when you delete the page or the content.

In particular, the following is not allowed:

  • unlawful content and content that infringes the rights of others,
  • hate, incitement, insults and threats,
  • sexual content or content glorifying violence,
  • content that violates the privacy of others,
  • advertising, spam and fraud.

Reports and removal

Every page can be reported: on the website with "Report", in the app through the menu. We look at reported pages, block them where necessary, and remove content that breaks the law or these terms. The point of contact for users and authorities under Art. 11 and Art. 12 of Regulation (EU) 2022/2065 is contact@memorabley.com; we answer in German, English and Spanish.

When we block a page or remove something, we record the reason. We have no contact details for the person who created the page: write to contact@memorabley.com with the address of the page, and we will tell you the reason and look at the decision again.

Third-party content

Linked songs and videos come from providers such as Spotify, Apple, YouTube or Vimeo. Their terms apply to their content.

Plans and prices

Designing a page is free. When you publish, you choose the plan that fits its content; you pay once per page, and people who write along never pay. The price shown to you before the order applies: on the website final prices in euros including VAT, in the app the prices of the App Store.

  • Free (€0.00): text, songs, places, up to 3 photos and one voice message.
  • Standard (€6.99): photos and voice messages without a limit on their number.
  • Premium (€12.99): everything in Standard, plus uploaded videos; the page stays online.
  • Keep forever (€4.99): a page with Free or Standard stays online. Whoever received the page can buy this too.
  • Upgrade to Premium (€5.99): lifts a page with Standard to Premium.

On the website you pay through Stripe, in the app through the App Store. A purchase applies to the page it was made for. Once published, a page can only take what its plan covers; for more it needs the larger plan.

How long a page is online

A page with Free or Standard is online for 30 days. The time starts when the recipient opens the page for the first time. After that the page can no longer be reached; we keep it for another 12 months and then delete it. Until then, “Keep forever” brings it back.

Pages with Premium, with “Keep forever” and from a subscription stay online until you delete them. The same goes for pages that were published before there were plans.

Subscription

The subscription belongs to an account. The first year costs €19.99, paid once, and includes 7 pages with Premium. After that it renews by one month at a time for €2.99 and includes one page with Premium per paid month. What is not used in a period is gone with it. The price of the first year applies to the first subscription of an account; whoever subscribes again later starts by the month.

Pages you published with the subscription keep Premium, also after the subscription ends. If a payment fails, no page can be published from the subscription until it went through.

You can cancel the subscription at any time to the end of the paid period: in your account, through “Cancel contracts here” at the bottom of every page of the website, or by emailing us. Before the switch to monthly billing we remind you by email. A subscription you took out in the app is cancelled in the subscription settings of the App Store.

Withdrawal and refunds

As a consumer you have a right of withdrawal; the details and a model form are in the withdrawal notice. This also applies once the page has been unlocked.

If we refund a purchase or a payment is charged back, the page loses the plan again. We do not delete its content because of that; the page then shows what the remaining plan covers.

Deletion

You can delete your page at any time, in the app on the device you created it on, or by emailing us.

If you have an account, you can delete it at any time, on the website under “Account” and in the app. Every page of the account goes with it, with its files, and a subscription that runs through the website ends at once. A subscription from the app goes on in the App Store until you cancel it there.

Liability

We are liable without limitation for wilful intent or gross negligence, and for death or personal injury. For services provided free of charge we are otherwise only liable for wilful intent or gross negligence.

Changes and governing law

We may update these terms when the service changes; the new version applies to pages created or changed afterwards.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of residence remain unaffected. As a consumer you can bring a claim against us in the courts where you live.
